You're good. You're good to go. Okay, now obviously he didn't release all of the 13 claims that Blake lively has he still is holding on to three we can go over those but the real meat and potatoes of this journey and of this court case and I think you guys can probably agree with me the real meat and potatoes of it is that Justin Bell Doney was a man that had a passion project and it was called it ends with us he he got the rights he secured the rights to option this this book he connected and and you know befriended the author Colleen Hoover. He poured his heart into it for five years and if you guys know the struggle of being a writer or director actor here in Los Angeles like it it's it's a journey okay it's not nothing's overnight. He did all of that and then right before they started production a few months before he scored Blake lively as his co lead which anyone would have been happy especially if you're a Justin bell Doney person of like level. Before this movie started and then of course everything went to shit right after that. I don't have the energy or the time to go into the details of it all but honestly you can listen to every single episode I've covered since December 20. December. December 26. I know she released her complaint on December 21 but I believed her I believed her is the truth because my gut instinct is to believe when someone says I was a victim of a B and C but unfortunately you can't blindly believe anyone anymore you can't play blindly believe. I blindly believe. Women. Hello look at what we're talking about with West Wilson and Amanda Batula right you can't blindly believe men. And you can't blindly believe someone that says that they were a victim of a B and C because ultimately it has to come down to the facts. And I am right now listening to Love Trapped which is the podcast series the phenomenally done podcast series around Clayton Eckerd who's the bachelor former bachelor and that. I don't even need to see allegedly but I guess in my opinion psycho Laura Owens and what she went through and the truth is is that women are sometimes just as capable of ruining lives and lying and creating a narrative about someone and taking them down. And very early on we clocked Blake Lively's intentions and lies. And I said this last night when I was live with Zach we did go live yesterday at like 3pm Pacific time so if you want to after that you can go watch that where Zach gets drunk and then ends up telling us about having sex with a little person we'll get into that later. We talked all about this the fact that. All she did to ruin his life was attached the word sexual. Sexual harassment was the was the thing that took him down and honestly. Had she just said hostile work environment. Or retaliation or ABCDEFG whatever. I don't think a I don't think it would have been a story the way it is now. I think not I think 90% of the people that are interested in the justice for Justin movement or anything like that. I think 90% of the people would have been like okay it's another story about it's kind of like the rebel Wilson story you know you hear about. Distrust on said are you here about hostile work environments it's like you hear about it you move on. But the fact that this Blake Lively was going after Justin Bell Doney for sexual harassment that is what. Captured the world's attention got the New York Times article because you know there would not have been a New York Times article based on if she thought that there was a smear campaign. Okay, that New York Times article was 1000% because of the words sexual harassment so Blake Lively and her nasty ass rat husband Ryan Reynolds intentionally ruined or attempted to ruin this man's life. Not only his his business partner Jamie Heath their wives families friends parents. It was such a domino effect and it was so egregious and I think you know being a woman myself that if God forbid something like that actually happened to me. I would want people to believe it if it was the truth and the most harmful thing you can do in my opinion like I said as a woman is to cry wolf. Is to create a narrative about something that is not real so that now every single time anyone hears about this they're going to say are you being a Blake Lively. Or are you telling the truth. And what I mean by Blake Lively it's are you exaggerating and creating a narrative about a man who said something that you didn't like you told him to stop and he stopped. And that's really what it came down to. Okay, he said that's hot about a onesie outfit that is the most unsexy thing I've ever seen in my entire life. She said she didn't like the way that he was talking and he stopped. I mean of course I'm not getting into detail there's a few other things. Yesterday this order comes out and I literally almost panic the way it goes I get a text message from my group of content creators that's Elsie that's Lauren that's Andy Signor that's Zach the four the five of us right. The Nordstrom Avengers I get a text message and it says, it says, oh my God, oh my God, oh my God, the claims are dead Justin Beldo oh my God 10 of 13 I literally my heart stopped I was in the middle of getting my my lunch I dropped it I was like, must run. It was such a crazy turn of events and so fast it happened so fast. And here we are I mean this is the real emotional journey of this and we're not even Justin's friends. I don't know Justin like I'm not friends with Justin Justin and I have never hung out and had coffee together like, you know, played pool together. I can only imagine what kind of anxiety and what kind of stress those guys and that whole team families etc have been holding on to for almost two years, a year and a half at least and then since they probably thought these claims are going to come out two years because he knew for months before the claims actually came out that something bad was going to happen. And remember the basement. Never forget the basement. Okay, banished to the basement at his own movie premiere. So what is the headline of yesterday and if you are seeing all of the different headlines there are massive amounts of a variety of headlines but what is the headline, the headline is that Justin Beldoni is no longer a defendant. In this case as Justin Beldoni personally. Yes, there are three claims that still hold and there are against it ends with us the movie and tag agency tag PR agency, but Justin Beldoni himself has been relieved of so many of the horrible claims that's the defamation. That's the I mean there's a whole list of them which we can get into but it is a massive, massive win and anyone that that claims that it isn't is blind. Okay, they're blind and they're trying desperately to hold on to threads of anything of any evidence because what you're going to see for a lot of people out there they're like, you know, I don't know if he's necessarily in the set. He, he did have a he got released on a technicality it got dismissed on a technicality is what a lot of them are now saying, but the reality is, is that the judge did make statements that did not just say he was he was dismissed on a technicality. He made statements that basically said you are it's not hitting the legal standard the evidence is not there. So, for example, and this is just kind of a general thing for anyone out there that is trying to kind of argue with people in your comments that are telling you that they are you know, wrong, that they're disgusting last night I got that I was a misogynist C UNT, which is really it's really interesting. This case has taught me more than anything that the women that believe Blake lively are the most disgusting, not all of course, but some of them are the most disgustingly rude horrendous people. They threaten you. They call you names. They, they, they offer horrible words up and these are the women that support women and they don't make it makes sense. So, I just don't understand that one. But a couple things happened about with this with this order okay the key takeaways is that obviously most of the claims were dismissed 10 out of the 13 claims were thrown out. And I conclude the sexual harassment defamation and conspiracy. So it was massively narrowed or as daily mail called it it was very thin now it's a very thin and why the sexual harassment claim was dismissed. Judge Lyman's reasoning is not only that she was considered an independent contractor not an employee and that's by her own doing. It's also that the alleged conduct appeared to be directed at her character in scenes, not her personally, and that is a huge legal distinction. It's very important to understand that he didn't just say the technicality. And I'm going to I have a word or a note about the technicalities in just a second. But we're still alive. We still have the breach of contract retaliation and aiding and abetting retaliation, which is mostly involving tag PR and the movie in general. And there, you know, a jury could infer retaliatory motive based on the evidence but a jury could also find that everything that happened was a legitimate PR slash reputation defense instead. And so I find that fascinating and interesting that that is basically what it is. So the case really is much more focused. There is just so much less in it. That is what was going to decide the case. So I think that's a very clear cut, which is why he's saying let a jury decide if you decide Blake to go all the way there and you want to take it to the limit, take it to the jury, go ahead. And so I find that much more focused. There is just so much less in it. That is what was going to destroy Justin Bell Doney as a human being. And a couple of things happened. Okay, I would say my gut feeling is being happy for Justin, obviously, but then a part of me feels like, oh, I really wish it would have gone to trial. I would say I would have gone to trial and get torn apart from the stand and testify and get torn apart for bringing this bullshit to the court system and to the jury and to waste so many people's time and energy. And the jury would obviously not have enough to find her on because legally there's just not enough evidence. Obviously, that's a risk. It takes longer. You have more time, more money involved, and you have to go through the stress of like being in court, you know, hearing arguments that you are a sexual predator, etc. It's really, in general, I think this is a great response. The negative about it is that the people out there that didn't get a certifiable jury verdict of not liable of sexual harassment, etc. They're going to hold on to this for the rest of their beings. And that's annoying. It's like you almost want, but I actually do think, and I was talking to, what's his name? Zach, yesterday, I was, I actually think that if had she gotten and like had they gone to trial and even if he was got a verdict of not liable of sexual harassment, etc. I do believe her people, and there's like four of them, I do believe that they would 1000% hold on to the fact that the system is not with women. She was wronged, etc. etc. So it's kind of one of those things that if you believe that Blake lively is innocent, then you're going to believe that Blake lively, you know, didn't do anything wrong this entire time vice versa. Like that's just, I think the way people operate. They're going to be stuck where they are until the end of days. Okay, so let's move on to a couple other parts of this that I think are really fascinating. The some of the strong quotes that came out of that order is that Bell Doney, the front this is all from the judge, of course, he said on the harassment not being directed at Blake lively personally he says the alleged conduct was directed at the character, not the plaintiff herself. You know when you get into a movie and you get hired as an actor, and it's called acting, and then you read scenes to each other or lines to each other and you say things to each other, maybe to get in the mood and especially if you're directing a scene and you're kind of like, like you're slow dancing. And then you like, nudge into their neck because you're supposed to look like you have a thing for them. Yeah, that's called acting Blake. Did you skip that part and like acting class when you were a kid. So he immediately said that it undercuts the core of the harassment claim because it reframes the behavior as part of the role and not personal misconduct Justin was rile. He wasn't Justin. The judge is saying it's not about Blake lively as a person it's about the character. Okay, now in terms of this other part is this, the fact that lively was not an employee under the law. And it's one of the biggest legal wins I'm sure they were aware that this was a possibility and this is what they were hoping for this entire time the judges saying she legally doesn't even qualify to bring some of these claims, which is massive. And that to me is so interesting because Blake lively has been so I hate to say this you guys Blake lively's team has been so intelligent this entire time of maneuvering the legal system, so that they could get away with what they've gone away with which is why Justin just in bell donies case was dropped. Go back to Justin bell donies case and why it was dropped that was dropped on a technicality, because of Blake lively's maneuvering doing this in California and under 47.1 independent contractor and not signing the contract and all these things, but all of those genius things that kept Justin from being able to sue her ended up coming right back in a karma. Amazing way to smack her in the face and say, Well, all these things that helped you along this long actually ruin your case. Sorry. Sorry Blake. And then some of the major claims multiple of these major claims failed to state a viable legal basis the judge said, even if you take all of these allegations as true. They still don't meet the legal threshold. It's not just we need more evidence it is even if it's true, it doesn't hold up legally. Okay, then on the defamation and conspiracy theories claims were dismissed for lack of sufficient factual support once again, not enough evidence. It directly weakens any narrative that there was a coordinated smear campaign the judge basically said, you'd improve that there was any real conspiracy here. Okay. And then, you know, on the other side, he could also be he the judge was saying that the defendants could reasonably reasonably be acting to protect the reputation. There's a legitimate non retaliatory explanation here, which gives bell don't a total total valid defense that he was protecting his project and himself, not retaliating, which I think is really important. And then I just think that at the end of the day judge Lyman just stripped the case down he threw out the most explosive claims, and that is a major win for bell don't a, but the retaliation claims still goes to a jury. And we'll see where it goes, you know, we'll see what happens there. I think the, the balloon was so filled and I think slowly slowly the balloon is kind of going down they have a conference called scheduled for settlement talks, Blake lively in my opinion would be ridiculously just dumb to take this to trial. At this point, it's very clear what's going on here and I don't think it's going in her favor. But now, a couple things, of course, our man Brian Friedman had a statement about this and he did. He did. Basically, I mean, as he should, he's very excited about this when he feels like it was a long time coming. And I think it's actually a really good statement. It's, it's like a pretty intense against Blake lively type of statement. But he basically says, oh my God, of course Blake lively came back against the the gloating quote from Brian Friedman I'll read that in just a second. It's coming, it's coming. It takes forever to find some of these things. I should just go. Honestly, I should just go to Zach Peters Instagram because I saw that he posted it. Okay, he said Blake can't handle the truth and the judge saw it basically. He said, in his, in his quote, he said, since the first day of this case when Justin and the other defendants were blindsided by these allegations, the legal team on the ground from the beginning have worked extremely long days and nights defending this case through transparency by releasing the actual truth, the text messages and by welcoming the facilitating and facilitating the release of all documents exhibiting the truth. The defendants were not afraid of the truth. Neither Justin Baldoni, Jamie Heath or any of the other defendants have engaged in the sexual harassment of Blake lively, despite them being accused of Darbo in defending these claims and despite our client being referred to in writing as a predator. What I said on behalf of our clients day one and every day since then is true. Our clients are very good people who have not engaged in the sexual harassment is alleged as such. They've deserved a vigorous defense which was led through transparency. It's gratifying to see the courts ruling confirm with the legal teams defend, defended from day one. Now Blake lively has fired back. Of course, they fired back. They immediately had a statement prepared yesterday, which basically said it was never about the sexual harassment. It's actually all about the retaliation, which citizen just citizen. What is it citizen justice over on on X. She said, citizen journalists, I knew I was saying something wrong. She said it's the friends scene where they're moving the couch up the stairs like pivot, pivot. They don't even know what to do. So that was their first statement. But now they're coming back after Brian Friedman's quotes, because he's pissed Michael Gottlieb, of course, because he spent 475 years on this. And he said, Gottlieb claims the judge decided to strip the case down to its core claims. That lively spoke out against what she believed was sexual harassment on the set and suffered retaliation that harmed her reputation as a result. He claims the court held that lively provided sufficient evidence that she was victimized by the onset behavior of Baldoni and producer Jamie Heath behavior. She felt was unlawful sexual harassment. Gottlieb says the court held she provided sufficient evidence to prove Baldoni, Heath and Wayfarer Studios understood that her claims amounted to sexual harassment allegations. Before they crossed the line in response and took steps that harmed her reputation and career. By the way, we talked about this yesterday. It's such a semantics issue. They're saying that Justin understood that it was sexual harassment, all because he said, I understand that what you're telling me is that you believe A, B and C. That does not mean I agree with what you're saying. And then of course, you know that he stopped it right after. He stopped even talking to them probably right after. And then he continued to add the court's ruling that misliably state and federal harassment claims could not go to trial was about legal issues rather than an endorsement of the defendant's conduct. The court held that misliably sexual harassment claims could not go to a jury because misliably did not sign a contract that she is an independent contractor instead of an employee and that the offensive conduct occurred in New Jersey instead of California. The fact that Brian Friedman is claiming exoneration based on legal technicalities while facing trial next month tells you everything you need to know. Yeah, I mean, I'm not shocked at all that an attorney would go to bat and try to fight for for this and try to kind of change the the story so that it sounds, you know, perfect for his client, but his client lost. You can look at it in black, you can look at it in white, you can look at it in Spanish, Hebrew, Chinese, Blake Lively lost this part of this of this case. I mean, there's no question, right. And you have to just understand that and just like I'm sorry that that's hard for some people to understand. But do not gaslight us into believing that Justin Baldoni is still a sexual harasser because I strongly believe that the judge would not have said all those things that it doesn't meet legal standards that there is not enough satisfactory evidence of a B and C. And if she feels so strongly about it, go ahead. Sue again, let's see what happens. Let's see what happens. Now we get a page six exclusive that says Blake Lively could be pushed out of the industry after brutal blow in Justin Baldoni's court battle. I love to see it actions have consequences. Just because you do something doesn't mean and like you're free to do whatever you want doesn't mean it's free from consequences get her out. I never want to see this be on a screen again. The article says, It says she could become Hollywood's persona non grata brand specialist Kayleigh Cornelius exclusively spoke with page six after a judge tossed her sexual harassment defamation conspiracy claims against Baldoni. And it says it does look like a challenging path lies ahead for Blake Lively Cornelius said there's a real risk she could start to feel pushed out of the industry and struggle to secure major roles or brand deals going forward.
